Justice Department Moves to Dismiss Lawsuit and Rescinds Fund

The United States Department of Justice moved on Monday to dismiss a class action lawsuit filed by individuals charged in the January 6, 2021, Capitol riot. The plaintiffs allege they suffered injuries resulting from excessive police force during the events, but the department argues these claims are prohibited under the Federal Tort Claims Act.

Government attorneys assert that the plaintiffs failed to meet the two-year statute of limitations, which expired on January 6, 2023. The department noted that the earliest claim from the named plaintiffs was not dated until July 29, 2025, and further stated that submitted forms were either incomplete or lacked signatures.

In a separate action on Sunday evening, Acting Attorney General Todd Blanche issued an order rescinding a 1.8 billion dollar anti-weaponization fund. This fund was intended to compensate allies of Donald Trump, though the order does not prohibit restitution for convicted January 6 rioters.
