Court Blocks Trump Administration from Firing 19 Intelligence Officers

The 4th U.S. Circuit Court of Appeals blocked the Trump administration from firing 19 career intelligence officers assigned to diversity, equity, inclusion, and accessibility (DEIA) initiatives. In a 2-1 decision, the court upheld a lower-court injunction, ruling that the Central Intelligence Agency (CIA) and the Office of the Director of National Intelligence (ODNI) violated the Fifth Amendment's due process clause and their own internal regulations.

The terminations were initiated by CIA Director John Ratcliffe and former ODNI Director Tulsi Gabbard to implement a January 2025 executive order signed by Donald Trump to eliminate DEI programs across the federal government. Judge Nicole Berner wrote for the majority that the agencies must provide these employees opportunities for reassignment and internal appeals before termination. The 19 officers are part of a larger group of 58 officials currently on paid administrative leave.

In a dissent, Judge Paul Niemeyer argued that agency directors possess "unfettered discretion" to terminate employees. The government maintained that intelligence directors have wide statutory authority to fire staff without cause. While the ruling does not permanently prevent the terminations, it requires the government to provide established procedural protections first. The administration is expected to appeal the decision.
