Federal Unions Sue Trump Over Shutdown Firings and Emails

Federal employee unions have filed multiple lawsuits against the Trump administration following a government shutdown that began on October 1, 2025. The American Federation of Government Employees is suing in the District Court for the District of Columbia, alleging the administration violated the First Amendment by modifying the out-of-office emails of furloughed Department of Education employees to blame Senate Democrats for the funding lapse. Deputy Assistant Education Secretary Madi Biedermann defended the move, stating the messages accurately reflect the legislative impasse.

Simultaneously, unions representing workers at the Environmental Protection Agency and the departments of Energy and Agriculture have sought a temporary restraining order in California to block threatened reductions in force (RIFs). Representative Eric Sorensen and legal advocates argue that the administration lacks the legal authority to implement mass firings during a lapse in appropriations, characterizing the threats as an attempt to intimidate career nonpartisan staff.

Rachel Greszler of the Heritage Foundation countered that while a shutdown does not independently authorize RIFs, the administration is preparing these plans in response to congressional spending demands. She suggested that the shutdown demonstrates agencies can operate with fewer staff. These legal battles unfold as federal employees, including TSA agents and National Hurricane Center meteorologists, continue to work without pay.
