Trump Administration Moves to Void Thousands of Asylum Claims

The Donald Trump administration has launched a nationwide campaign to void thousands of active asylum claims by redirecting migrants to third-party nations. U.S. Immigration and Customs Enforcement attorneys filed over 8,000 pretermit motions by early December, requesting that judges dismiss cases without merit hearings. The government argues that applicants can seek protection in partner nations such as Guatemala, Honduras, Ecuador, Uganda, and Palau, even if the migrants have no prior ties to those countries.

This strategy follows a ruling from the Board of Immigration Appeals requiring judges to prioritize third-country deportation motions over asylum applications. The administration aims to close a legal loophole and reduce a backlog of nearly 3.75 million cases, projecting approximately 600,000 deportations in its first year. This effort is supported by a congressional spending package providing $170 billion in additional funding for immigration enforcement through 2029.

To further restrict access, the administration is invoking a pandemic-era public health regulation that allows authorities to bar migrants at ports of entry based on communicable disease concerns. This measure supplements a broader asylum ban implemented by the president upon returning to office in January. While the Department of Homeland Security defends these actions as lawful tools to curb system abuse, the American Immigration Council argues the tactics demolish humanitarian protections and bypass international legal obligations.
