Brazil Electoral Court Manages Record AI Litigation Ahead of Runoff
Brazil's Superior Electoral Court is processing 804 legal filings regarding deepfakes and algorithmic bias in the presidential runoff between Luiz Inácio Lula da Silva and Flávio Bolsonaro.
The Superior Electoral Court of Brazil is managing a record 804 legal filings as the country prepares for a presidential runoff between President Luiz Inácio Lula da Silva and opposition candidate Flávio Bolsonaro. The litigation focuses on the use of artificial intelligence and deepfakes to manipulate digital campaign content.
While the court has banned deepfakes in electoral advertising, it declined to sanction Flávio Bolsonaro over an AI-generated video featuring his father, Jair Bolsonaro. Simultaneously, the court ordered Meta to ensure equal treatment of both candidates after the Lula campaign alleged that biased algorithms favored the opposition. Meta denied these claims, stating that any platform issues were the result of technical failures.
The controversy has drawn international attention, with a group of U.S. lawmakers, including Senator Bernie Sanders, sending a formal letter to Meta CEO Mark Zuckerberg. The lawmakers requested an independent audit and detailed explanations regarding potential disparities in how Meta's platforms treated the two candidates during the election cycle.
