US States Challenge 221 Donald Trump Executive Orders

Donald Trump signed 221 executive orders between January 20 and December 18, 2025, sparking a wave of bipartisan legal challenges from state governments. These actions targeted birthright citizenship, the rejection of absentee ballots arriving after Election Day, and the removal of election powers from state control. State officials also fought federal efforts to federalize the National Guard for deployment in Washington and Illinois.

Economic disputes emerged as 12 states joined Oregon to challenge the use of emergency powers to impose tariffs on Canada, Mexico, and China. An analysis by States United found that at least 33 of the president's orders face federal court challenges, with 10 of the most controversial mandates currently blocked or paused. Additionally, the Department of Justice faced bipartisan opposition for attempting to access voter data.

While the Supreme Court's conservative majority has trended toward expanding presidential power, state governments have acted as a constitutional check to preserve local authority over crime and elections. White House Chief of Staff Susie Wiles characterized the president's approach as operating with a view that there is nothing he cannot do. In response, States United CEO Joanna Lydgate asserted that the struggle against executive overreach would ultimately be decided in the court of public opinion.
