Sonia and Rahul Gandhi Petition Delhi High Court Over National Herald Case

Sonia Gandhi and Rahul Gandhi have petitioned the Delhi High Court to dismiss a money laundering case brought by the Enforcement Directorate (ED) concerning the National Herald. The Congress leaders argue the prosecution is based on extraneous considerations and represents a unique instance in India where the agency initiated proceedings via a private complaint instead of a First Information Report.

The legal challenge highlights a seven-year gap between a 2014 complaint filed by former Union Minister Subramanian Swamy and the 2021 registration of the Enforcement Case Information Report. The Gandhis contend this delay proves the agency is deviating from its own legal interpretations to target them.

While a trial court ruled the matter unmaintainable and refused to take cognisance on December 16, 2025, the ED challenged that decision the following day. The Gandhis have characterized this rapid appeal as an "abuse of the process." Justice Sachin Datta has adjourned the hearing until October 12.
