Democratic States Sue to Block TANF Data Sharing Policy

A coalition of Democratic-led states filed a federal lawsuit in Washington on August 3, 2026, to block a Trump administration policy that allows the sharing of welfare recipient data with federal agencies. The policy, announced in June by the Administration for Children and Families, permits the government to share records from the Temporary Assistance for Needy Families program with agencies such as the U.S. Department of Homeland Security to verify immigration status. The initiative is scheduled to take effect on August 11.

State attorneys general argue the policy violates the Administrative Procedure Act and the U.S. Constitution, asserting that states hold the legal responsibility for verifying applicant eligibility. The Administration for Children and Families maintains the data sharing is necessary to ensure states properly verify citizenship and immigration status before benefits are distributed.

California Attorney General Rob Bonta and New York Attorney General Letitia James led the legal challenge. Bonta claimed the administration is exploiting a program designed to prevent childhood hunger to fuel a mass surveillance effort, while James stated the administration is turning antipoverty programs against the people they are intended to serve.
