Federal Judge Blocks Deportations of Students Criticizing Israel

A federal judge in California ruled that the Trump administration violated the First and Fifth Amendments by attempting to deport international students who criticized Israel's war in Gaza. Judge Noël Wise found that the government used vague immigration laws to target students for protected speech, asserting that the freedom to criticize government leaders is evidence of democratic strength rather than fragility.

The ruling follows a lawsuit brought by the Foundation for Individual Rights and Expression on behalf of The Stanford Daily. The student newspaper argued that its staff members were forced to resign or self-censor due to fear of government retaliation. The court identified that Secretary of State Marco Rubio personally signed off on decisions to revoke visas or render students deportable, including activists Mahmoud Khalil and Rumeysa Ozturk, by labeling their speech a threat to U.S. foreign policy interests.

Judge Wise noted that democratic strength is diminished when citizens and noncitizens must behave or suffer retaliation. Conor Fitzpatrick, the chief supervising attorney for the plaintiffs, stated that the ruling proves free speech is an inalienable right rather than a privilege.
