Lawsuit Challenges Trump Media's Paid Truth API Access

The Intercept and the Freedom of the Press Foundation filed a federal lawsuit in the Southern District of New York against Donald Trump, his aides, and Trump Media & Technology Group (TMTG). The suit seeks to block the Truth API, a subscription service launched on August 1 that charges between $60,000 and $100,000 per month for high-speed, machine-readable access to posts from high-profile accounts, including the president's. Plaintiffs argue the service violates the First and Fifth Amendments by privatizing market-moving government information for personal profit and denying the public equal access to official announcements.

Trump Media CEO Kevin McGurn defended the API as a standard commercial practice that provides public posts fractionally faster to customers, including high-frequency trading firms. The company launched the service amid financial instability, reporting a $238 million net loss for the second quarter ending in June, largely due to declining cryptocurrency holdings.

The legal challenge is accompanied by political backlash. Representative Jamie Raskin launched an investigation into potential insider trading, while Senators Mark Warner and Ruben Gallego introduced legislation to ban the sale of special access to government employees' social media accounts. Additionally, Senators Elizabeth Warren and Adam Schiff urged the Securities and Exchange Commission to investigate potential securities law violations. TMTG has dismissed the opposition as a left-wing attempt to censor the president.
