Federal Judges Challenge Trump Administration's Transgender Military Policies

Federal courts are challenging the legal and financial justifications for the transgender military ban enacted by Donald Trump. In the case Talbott v. United States, U.S. District Judge Ana Reyes ordered the Department of Defense to explain the disparity between its restrictions on hormone therapy for transgender men and a new program announced by Secretary of Defense Pete Hegseth on July 15. Hegseth's initiative provides annual testosterone screenings and voluntary replacement therapy for cisgender service members aged 30 and older to enhance lethality and readiness.

Judge Reyes is questioning whether the Pentagon's medical justifications for the transgender ban are applied consistently, given that the administration argues gender-affirming therapy negatively impacts combat readiness and increases costs while promoting similar therapy for cisgender soldiers. The case has been granted class-action status and is moving toward a trial scheduled for January 4, although the Supreme Court has allowed the ban to remain in effect during litigation.

Simultaneously, U.S. Court of Federal Claims Judge Elaine D. Kaplan rejected a Justice Department motion to dismiss a lawsuit filed by 17 transgender Air Force service members. These plaintiffs allege the government unlawfully revoked approved early retirement orders and replaced them with lower-value separation pay following a 2025 executive order. Judge Kaplan ruled that the government improperly conflated the merits of the claims with the court's jurisdiction and allowed plaintiffs to file supplemental complaints by August 4 to address technical timing issues.
