As of late August, the U.S. Treasury and Customs and Border Protection have disbursed over $100 billion, with the majority of funds flowing to large corporations. Major recipients include Walmart, which received $2.9 billion, Apple with $2.2 billion, and Target with nearly $1 billion.
A conflict has emerged over whether these windfalls should be passed to consumers. While shipping firms like FedEx and UPS have pledged direct refunds, most retailers are resisting. Walmart and Target are implementing general price cuts, while Apple is reinvesting its funds into American manufacturing. Other companies, such as Home Depot and PepsiCo, are using the money to offset rising energy and freight costs. Nintendo has formally refused to pass on refunds, arguing the payments were part of the goods' purchase price.
These discrepancies have triggered multiple class action lawsuits against companies including Nike, Sony, and Costco, with plaintiffs alleging a double recovery windfall. Treasury Secretary Scott Bessent characterized the rebates as ultimate corporate welfare, while the Tax Foundation warned that the chaotic tariff regime caused lasting economic damage. Despite the ruling, Donald Trump has asserted that the tariffs brought in hundreds of billions of dollars and is seeking alternative legal mechanisms to re-establish a similar tariff regime.
