Judge Refuses to Dismiss Lawsuit Over Trump Compensation Fund

U.S. District Judge Leonie M. Brinkema refused to dismiss a lawsuit challenging the creation of a $1.8 billion anti-weaponization fund intended to compensate political allies of President Donald Trump. During hearings in Alexandria, Virginia, the United States Department of Justice argued the case is moot because the fund was formally terminated on August 2. However, Brinkema stated that the underlying issues remain "alive and kicking," noting that President Trump has continued to publicly support the fund despite the administration's official stance.

The fund was originally designed to resolve a lawsuit by Trump against the IRS regarding leaked tax returns, but it faced bipartisan backlash over the possibility that January 6 Capitol rioters could receive payments. Plaintiffs, including the legal advocacy group Democracy Forward and a union representing IRS workers, argue the fund is an unlawful attempt to use taxpayer money as a political slush fund.

Judge Brinkema expressed concern that the administration might seek "functional equivalents" to funnel money to allies, such as settling lawsuits filed by January 6 participants. To prevent the Justice Department from using the general Judgment Fund for such purposes, she suggested appointing a neutral overseer. The litigation also challenges a separate measure granting President Trump and his family immunity from past tax investigations, which Brinkema questioned could violate statutes requiring independence in tax audit decisions.
