Supreme Court Allows Trump Mail-In Voting Restrictions to Proceed

The Supreme Court of the United States ruled 6-3 on Monday to lift a lower-court injunction that had blocked a March executive order from President Donald Trump. The order seeks to restrict mail-in voting for the 2026 midterms by requiring the United States Postal Service to deliver ballots only to individuals on federal citizenship lists. The majority held that a coalition of 23 states and Washington, D.C., lacked standing because their claims of harm were premature and speculative.

While the ruling allows the administration to proceed with preparations, the Court did not determine if the order is constitutional. Justice Ketanji Brown Jackson dissented, arguing the decision "needlessly injects chaos and uncertainty into the upcoming midterm elections." Other dissenting justices, including Sonia Sotomayor, noted the ruling does not grant the executive branch statutory authority to interfere with state-run elections.

Implementation remains uncertain as a separate nationwide injunction issued by U.S. District Judge Indira Talwani continues to block the United States Postal Service from enforcing its final rule. Judge Talwani recently stated the agency "feigned compliance" with her directives after the USPS released a 95-page final rule on August 22. Democratic governors and attorneys general from states including California, New York, and Oregon have condemned the order as federal overreach and vowed to continue legal challenges to protect state-managed election processes.
