UK Migrant Deportations to France Stalled by Legal Challenges

The UK government's 'one in, one out' migrant return deal with France has failed to launch after legal challenges blocked the first scheduled deportation flights.

The Government of the United Kingdom has faced immediate setbacks in implementing its 'one in, one out' pilot scheme to return asylum seekers to France. Established in July by Prime Minister Keir Starmer and French President Emmanuel Macron, the deal exchanges migrants who crossed the English Channel in small boats for approved applicants moving to Britain. Despite detaining approximately 92 people at Brook House and Harmondsworth centers, the government has failed to complete a single deportation as of mid-September 2025.

Scheduled deportation flights from Heathrow Airport to Paris on September 15 and 16 departed without migrants after last-minute legal challenges and reports of inadequate vulnerability notifications provided to French authorities. On September 16, the High Court of Justice granted a 14-day interim injunction to block the removal of a 25-year-old Eritrean man. Mr Justice Sheldon ruled there was a "serious issue to be tried" regarding a trafficking claim and whether the Home Office conducted its investigatory duties lawfully.

Home Secretary Shabana Mahmood and Technology Secretary Liz Kendall have defended the policy, asserting that individual legal setbacks will not undermine the fundamental basis of the deal. However, the French Interior Ministry warned it may terminate the agreement if it remains unsatisfactory. Opposition leaders, including Conservative leader Kemi Badenoch and Shadow Home Secretary Chris Philp, have characterized the scheme as a "failed gimmick" and a waste of taxpayer money, estimating that the aborted flights cost approximately £500,000.
