These actions follow whistleblower allegations that former Justice Department official Emil Bove suggested attorneys ignore court orders. While some Trump-appointed judges have facilitated administration victories in the Supreme Court and DC Circuit, others have pushed back. In Rhode Island, Judge Mary McElroy chastised the Department of Housing and Urban Development for failing to follow court orders regarding grant payouts.

Chief Justice Bartholomew Roberts held a private meeting where judges expressed concerns that the administration's tactics signal a diminishing check on executive power. Some members of the judiciary have warned that these efforts to evade court orders and intimidate judges are creating an incipient constitutional crisis, though the administration continues to participate in many standard legal proceedings.
