The Industry Fled the Town Halls. The Politics Followed.

The AI industry's escapes into the ocean and onto the phone traded zoning boards for tribal councils and a regulatory gap no one has written rules for.

DeepGreen wants to sink 350 tidal turbines and a rack of servers into Alaska's Cook Inlet, and it has filed the federal paperwork to do it. The filing describes how the project would connect to the Cook Inlet PowerLink. The Alaska Energy Authority, which runs that grid, says it was never contacted [1]. A developer is asking Washington for permission to build in a state whose own energy authority learned about the project from the filing. That is the whole story in miniature: the industry left the zoning board for a venue it doesn't know how to navigate. The reason it left is on the record. Between April and June, U.S. communities blocked or delayed $98 billion in data center proposals across 11 states [2]. Microsoft put the risk in a securities filing, where operational threats get listed in the plainest possible language.

Maine went further than any state, passing the first statewide moratorium on large data centers in April, a freeze on new facilities over 20 megawatts that runs until late 2027 [3]. The industry had two ways out: down into the ocean, and out onto the phone in your pocket. The ocean route ran straight into a different set of people. In Passamaquoddy Bay, Maine, DeepGreen's $100 million project — 34 server pods and 50 tidal turbines — drew opposition from Peskotomuhkati leaders who warned it threatens traditional fisheries and an already strained ecosystem [1].

The Eastport City Council enacted a six-month construction moratorium, and the statewide freeze landed on top of it [3]. The other escape route looked cleaner, and in one sense it is. Google's AI Edge Gallery runs generative models entirely on a phone's processor, no cloud required [4]. But the edge doesn't solve the regulatory problem so much as step around it. In New South Wales, an inquiry is weighing whether to tie data center planning approval to AI ethics certification, requiring operators to certify their models are free of stolen work before they get a development permit [5]. A model running on a phone never applies for that permit, so it never meets the condition. Regulators are learning to attach AI-ethics conditions to the thing the industry is leaving behind, while the thing it's moving toward has no such hook at all. The industry's own people say so: Tekskills' chief executive warns that AI-powered devices are deploying faster than any legal framework, leaving an accountability gap when autonomous systems make decisions no one can be held to account for [6]. Back in the ocean, the federal government was trying to broker the relationship the industry never built. The Department of Energy has been facilitating tribal-data center partnerships, and one developer's representative put the pitch plainly.

That framing splits Indigenous communities down the middle. The Seminole Nation passed a permanent moratorium; the Muscogee Nation rejected rezoning; Honor the Earth is tracking more than 100 proposed projects under a "Stop Data Colonialism" banner [7]. Sovereignty turned out to be a tool the industry could reach for, and one it could not control. Beyond any nation's waters, the governance is thinner still. The UN High Seas Treaty took effect in January, requiring environmental impact assessments in international waters and allowing marine protected areas by three-quarters vote, but it specifies no enforcement mechanism for remote ocean regions [8]. A data center sunk beyond national jurisdiction would fall into exactly that gap: a rule with no one to apply it. The pattern shows up even where the venue is familiar. In Broken Arrow, Oklahoma, a developer withdrew after its letter of intent expired without ever requesting a formal application or a pre-development meeting with city officials [9]. The city manager said he expects more proposals, but the first one left without engaging. Arrive at a new venue, file the paperwork, leave without talking to anyone. The same motion in Alaska and Oklahoma. China's version of the ocean route is running without any of this. Its wind-powered underwater data center in Shanghai is fully operational, using 95% green electricity and no freshwater or land [10]. There is no tribal council to consult, no municipal moratorium, no environmental review, because the state directed the project and there is no local consent mechanism to trigger. The ocean doesn't create politics. Democracy does. The friction the industry keeps hitting isn't geographic. It's institutional. The town halls it fled were places it had learned, however grudgingly, to work: the hyperscalers can afford to compensate communities and absorb the cost of local negotiation [11]. The venues it fled to are the ones where it has no relationships and no playbook. Tribal councils, high-seas governance, a regulatory regime for AI that no legislature has written. It left the rooms it knew for rooms where it doesn't know anyone's name.
