Four months, one agency, opposite directions. The arc is not a policy tweak. It is a signal that the federal government has decided the AI race takes priority over the environmental law that, until January, it was enforcing — and it is willing to override state authority to make that stick. The companies did not plan for this fight. They went off-grid to avoid a different one. When a data center connects to the public grid, the conflict follows a familiar shape: who pays for the new transmission lines, the substation upgrades, the reserve capacity. That fight has a forum. The strategy worked, in one sense: it bypassed the interconnection queue. But it also removed the utility as intermediary — and the utility was the only institution with a settled framework for mediating the conflict. FERC can reform tariffs. It can require cost-sharing. What it cannot do is tell a company whether it may build its own gas plant behind the meter. That question falls to a patchwork of state environmental agencies, federal air permits, and — as it turns out — the Department of Defense. The sovereignty conflict is now playing out in its purest form. In April, the NAACP and Earthjustice sued xAI over 27 unpermitted turbines near Boxtown, a predominantly Black community in Memphis, arguing the facility could become the largest industrial source of nitrogen oxides in the metro area [6]. The Department of Justice and the Department of Defense then argued against shutting the turbines down, citing national security: the military relies on the Grok AI system hosted at Colossus II [7]. The federal government is not merely declining to enforce environmental law — it is actively intervening to prevent a state-level enforcement action from succeeding, on grounds that have nothing to do with air quality. The split is geographic, and it tracks the fault line between states aligned with the federal AI push and those that are not. In Texas, the TCEQ approved the largest air permit in American history for the 7.65-gigawatt GW Ranch project — 33 million tons of CO2 per year — with Pacifico Energy promising it would deliver power without burdening local ratepayers or the regional grid [8].

In New York, Governor Kathy Hochul imposed the nation's first statewide data center moratorium on July 14, requiring her environmental agencies to develop comprehensive standards for energy, water, and air quality before any new project proceeds [9].

President Trump called the moratorium a "terrible decision" and described data centers as "liquid gold" and "money machines" [9][10]. Energy Secretary Alfie Moon vowed the administration would "roll over the opposition to data centers faster than we otherwise should" [10]. In Congress, the same divide appeared: Senator Tom Cotton proposed legislation to let data centers connect directly to unregulated power plants, while Senator Bernie Sanders and Representative Alexandria Ocasio-Cortez introduced a moratorium act — Sanders going so far as to say he would block new data centers even if states want them and they generate their own power [10][11].

The fight is not theoretical, and it is not temporary. The infrastructure being locked in now will outlast any single administration. In May, Musk's SpaceX acquired gas turbine provider APR Energy for roughly $1 billion, securing a fleet of 59 mobile gas and diesel turbines to power Colossus II [7]. The same month, Energy Transfer disclosed it had contracted over 6 billion cubic feet per day of new pipeline capacity for AI data centers, including a 20-year agreement with Entergy Louisiana to supply Meta's facility in Richland Parish and 900,000 Mcf per day for Oracle's three Texas sites [12]. These are not bridge commitments. A 20-year pipeline contract signed in 2026 runs to 2046 — well past the 2031 target date for TerraPower's advanced nuclear reactor in Wyoming, and past any plausible timeline for nuclear to scale to meet AI demand [13]. SpaceX's own regulatory filing for the APR Energy acquisition quotes Musk saying that burning fossil fuels is "the dumbest experiment in history, by far" and that solar is the only truly scalable solution [7].

FERC's June order can reform interconnection processes, prevent cost-shifting onto captive ratepayers, and require transparency from grid operators — the commission's jurisdiction covers tariff and cost-allocation questions for the shared grid [1]. But when a company builds its own gas plant behind the meter, FERC has no jurisdiction over whether that plant gets built, what it burns, or whose air it pollutes.
