Marco Rubio Announces Visa Bans for Child Abduction Obstruction

Secretary of State Marco Rubio announced a new policy on Monday to restrict visa issuance for foreign individuals who obstruct the resolution of international parental child abduction cases. The restrictions target foreign government officials, judges, judicial administrators, and law enforcement officers who intentionally fail to comply with laws or court orders intended to return children to their country of habitual residence. These penalties may also extend to the immediate family members of the responsible parties.

The measure follows a State Department annual report identifying 14 countries, including South Korea, Argentina, India, and the United Arab Emirates, as demonstrating a pattern of noncompliance with the 1980 Hague Abduction Convention. The report specifically criticized South Korean authorities for regularly failing to enforce return orders, including one case pending since 2019. The policy also applies to other parties to the convention, such as Pakistan.

Rubio characterized the visa restrictions as an accountability tool to pressure non-compliant countries to meet their international obligations. The Trump administration stated that protecting American children abducted across borders and reuniting them with their parents is a top priority.
