Judge Blocks Trump Visa Ban Targeting Disinformation Researchers

Chief U.S. District Judge James Boasberg issued a preliminary injunction on July 14, 2026, blocking the Donald Trump administration from enforcing a State Department policy that targeted foreign nationals working in content moderation, disinformation research, and fact-checking for visa denials and deportation.

The ruling followed a lawsuit by the Coalition for Independent Technology Research, which argued that the policy likely violates the First Amendment by unlawfully burdening the speech of non-citizen researchers. Judge Boasberg determined that the policy could be reasonably understood to risk the immigration status of researchers based on their professional work rather than ties to foreign sovereign power.

Secretary of State Marco Rubio had defended the restrictions, which targeted those he described as complicit in a censorship-industrial complex and accused of censoring American citizens and conservative voices. This policy followed December bans on five Europeans, including anti-disinformation activists, after the European Union fined Elon Musk's X company. Those affected by the bans included the CEO of the Center for Countering Digital Hate and the co-founder of the Global Disinformation Index.

The United States Department of State maintained that individuals complicit in censoring Americans should face consequences, asserting that a visa is a privilege rather than a right.
