DOJ Sues to Block Alaska Senate Certification Over Spoiler Candidate

The U.S. Department of Justice filed a lawsuit to block Alaska's Senate election certification if a namesake spoiler candidate costs incumbent Senator Dan S. Sullivan the seat.

The United States Department of Justice filed a federal lawsuit in Alaska seeking to block the certification of the U.S. Senate election results if incumbent Republican Senator Dan S. Sullivan loses to Democrat Mary Peltola. Directed by President Donald Trump, the suit argues that the presence of Daniel J. Sullivan Jr., a retired teacher with a nearly identical name, was intended to mislead voters and undermine the election's integrity. The DOJ requests that certification be halted if an investigation reveals the incumbent would have won had the namesake's votes been attributed to him.

This legal action follows a June ruling by the Supreme Court of Alaska that allowed Daniel J. Sullivan Jr. to remain on the ballot despite earlier attempts by state officials to remove him. Attorney General Todd Blanche defended the suit as a necessary guardrail under the National Voter Registration Act, while critics and Republican Senator Lisa Murkowski characterized the intervention as an unprecedented federal power grab.

Recent reports from The New York Times allege that the Peltola campaign and the Democratic Senatorial Campaign Committee orchestrated a secret "ballot composition project" to recruit spoiler candidates, including Daniel J. Sullivan Jr., to dilute support for the incumbent. Former campaign manager Elisa Rios claimed Peltola was aware of the project, though the campaign and DSCC have denied any involvement. In response to these reports, Donald Trump labeled the operation "election fraud" and demanded legal consequences for Peltola.
