The proposed law would apply to both current visa holders and new applicants. It would also prohibit public schools from entering financial agreements or accepting gifts from foreign sources. Abbott framed the move as a response to the federal government's failure to control H-1B visas, noting that Texas must put its foot down to prioritize local workers.

This proposal follows a January order by Abbott that froze new H-1B petitions for state agencies and public universities through May 31, 2027. The initiative aligns with efforts by the Donald Trump administration to limit the program to prevent the replacement of American workers.

Dallas Independent School District is the most affected entity, employing 171 H-1B visa holders—the highest number of any district or public university in the state. District officials responded that they hire foreign educators only to fill critical shortages certified by the Texas Education Agency. They warned that if the governor eliminates these teachers, the state will need more Texans in the teaching pipeline. The Texas Legislature must pass the policy changes when it convenes next year for the proposal to become law.
