The Supreme Court of the United States issued a procedural ruling on Tuesday that favors the administration of President Donald Trump in a legal battle over speech restrictions for federal immigration judges. The court overturned a previous decision by the 4th U.S. Circuit Court of Appeals, finding that the lower court violated the party-presentation principle by relying on arguments not raised by the National Association of Immigration Judges.
The conflict stems from a 2017 policy requiring judges to obtain prior approval before making official public remarks. The administration contends that grievances regarding this policy must be processed through the federal employee complaint system, including the Merit Systems Protection Board, rather than through federal courts.
Acting Attorney General Todd Blanche welcomed the decision, stating that judges should resolve cases without attempting to seize the role of Congress. While the ruling is a procedural setback for the judges, it does not determine the legality of the speech policy itself, leaving the door open for future legal challenges.
