The Data Center Moratorium Is Not a Wall
Local bans are spreading fast, but they are legally fragile opening moves in a fight that is migrating to the courts — and the result is more litigation, not fewer data centers.

Hamilton County, Tennessee extended its data center moratorium this month. The mayor who presided over that vote, Weston Wamp, had already told his own county what he thought of the tool he was using. A moratorium without permanent zoning code changes, he warned, was legally vulnerable — the kind of stopgap a developer could challenge in court and overturn, producing the very outcome it was meant to prevent. The admission is the organizing image for where the American data-center siting fight now stands: the moratorium is the weapon of choice, and the people wielding it are not sure it works. The previous consensus settled who pays for AI's power bill. From FERC to the Texas governor to a unanimous House vote, every level of government agreed: data centers must cover their own grid costs. That agreement was real, bipartisan, and silent on the harder question — where the centers can actually be built. Trump's July 2025 executive order designating data centers as critical national security infrastructure did not preempt local zoning authority [1]. A federal moratorium bill introduced by Representatives Ocasio-Cortez and Sanders did not pass. So the siting fight fell to thousands of small jurisdictions, and what has emerged is not a wall but a legal arms race. The breadth of the response is real. Fourteen states have considered moratorium bills. More than $130 billion in projects were blocked or delayed in the first quarter of 2026 alone — 75 projects, including a $1 billion Google proposal in Indianapolis and Amazon's $3.6 billion campus in Tucson [2][3]. In Montana, a ballot initiative would require a two-thirds supermajority to approve any data center [5]. The patchwork is so fine-grained that the same month produced a vote in Decatur, Georgia to remove size and power restrictions on data centers, while Dorchester County, Maryland began studying a moratorium modeled on its neighbors [6]. But a moratorium is an opening move, not a final one. Wamp's warning in Hamilton County was not abstract — it described the legal reality that developers are already exploiting. In Upper Hanover, Pennsylvania, attorney Celso L. Leite Jr. filed what is called a validity challenge.

The argument is a direct attack on the premise of a ban: that blanket exclusion is itself illegal. It is the developer countermove in a fight that is rapidly moving from council chambers to courtrooms. Both sides are now lawyering up. In Hermantown, Minnesota, a citizens group sued to block Google's rezoning for a data center, alleging spot-zoning, closed meetings, and nine separate counts [7]. In Sangamon County, Illinois, landowners sued to overturn the county's approval of a CyrusOne data center, arguing the county used a conditional-use permit to dodge a formal rezoning that would have required a supermajority the 17-to-10 vote could not meet [8]. Citizens sue to block approvals; developers sue to overturn them. The moratorium is the opening bid, and litigation is the table the game moves to. Developers have a second countermove that never reaches a courtroom: jurisdiction-shopping within a single county. In Newton County, Georgia, officials opposed developer efforts to annex county land into adjacent cities to bypass restrictive county zoning — a cat-and-mouse game between local rules and developer tactics [9]. The moratorium draws a line; the developer redraws the map. The Maine experience is the clearest illustration of how the fight migrates downward. Governor Janet Mills vetoed a statewide moratorium bill. So individual towns passed their own — Bangor, Westbrook, Brunswick, Sanford, Scarborough. When the state declines to act, the town does. The result is not a coherent policy but a quilt of local decisions, each one a potential lawsuit waiting to happen. The patchwork is starkest where it is densest. In Los Angeles County, Monterey Park became the first U.S. city to ban data centers outright [10]. Neighboring El Monte passed a 45-day moratorium. And the city of Vernon, a few miles away, welcomed them — to replace legacy industrial users and stabilize municipal electricity rates. Vernon's city administrator put the contradiction plainly.

That sentence — they have to go somewhere — is the gravitational constant that keeps the whole cycle spinning. Every ban in one jurisdiction increases the pressure on the next. The maze has no exit, only more corridors. Why are small jurisdictions the arena at all? Because they are the only ones left holding the zoning power, and many are overwhelmed by what they are being asked to decide. Crawford County, Georgia, is a rural jurisdiction that suddenly found itself facing a data center application. County Attorney Joel Sherlock told officials the situation was unprecedented.

The local capacity gap is itself a driver of moratoriums. When a county does not have the rules or expertise to evaluate a billion-dollar proposal, the safest move is to pause everything — and that pause, as Wamp warned, is legally vulnerable the moment a developer challenges it. The build-out has not stopped. McKinsey estimates seven trillion dollars in global data center investment by 2030 [11]. xAI is reportedly planning three gigawatts of new capacity in Texas by the end of 2027 [12]. The moratoriums are redirecting the flow, not blocking it — into rural counties that are now passing their own moratoriums, into welcoming states like Texas that are discovering the fiscal cost of being the pressure valve, and overseas, where companies like Bitzero have expanded into Norway and Finland explicitly to escape restrictive U.S. jurisdictions [2]. What the moratorium wave has produced is not a wall but a legal arms race with no obvious endpoint. The moratorium is the opening gambit. The validity challenge is the counter. The lawsuit is the escalation. And the jurisdiction-shopping end-run keeps the whole thing moving. Both sides are lawyering up, courts are becoming the default venue for a fight that began in council chambers, and the Vernon administrator's observation — they have to go somewhere — ensures the cycle does not stop. More litigation, not fewer data centers.
