Who Holds the Paper After the Count

The administration lost the fight over who votes — and rebuilt its campaign around the ballots, machines, and records that remain once the count is done.

Their job is not to watch who gets to vote. It is to record the serial numbers and security seals on voting machines, while election officials in Washington and twenty-nine states sit under federal orders to preserve their 2024 voter-registration records [1]. That is an inventory of equipment and a lock on old paperwork. The distance between the headline and the assignment is the whole story. The campaign began in May as a volunteer "Election Integrity Army" in every state [2], and by July it was federal machinery — the president saying Republicans should take over voting in at least fifteen places, and a 95-page postal rule that would refuse mail ballots from any state that withheld its voter rolls [3][4]. Then, in mid-September, the courts broke the centerpiece. The Supreme Court blocked the postal rule, the Postmaster General halted the screening portal, ballots went out on schedule — Colorado moved its mailing twenty-nine days early to stay ahead of any federal disruption — and a judge dismantled the threat to withhold counterterrorism grants from uncooperative states [5][6][7][8]. The blockade did not survive. But the Postal Service had already finalized the blocked rule anyway, keeping it loaded so it could take effect the moment any court reversed itself [4]. The ruling was interim, the case left open [9]. And when the rule fell, the auditors redeployed — moved off the mail system and into field enforcement of election-law compliance [10]. The rule that lost in court came back as people on the ground. Run what survives through one test: does it touch who votes on November 3, or what exists after the count? The new prosecutions come faster than one a day, and fifteen of the sixteen noncitizens charged allegedly voted in 2024 — not in the election three weeks out [11]. Their trials run through December 14 [12]. Charging 2024 conduct cannot change who is eligible next month; it can only fill a courtroom calendar once the votes are in. The preservation orders cover 2024 registration records, not current ones [1]. The monitors record serial numbers and seals, for a purpose no official has stated [1]. And whether agents may enter polling places at all stays deliberately unresolved — the president refused to rule it out [13].

There are real cases underneath all of it — a New Jersey software error that put roughly 6,600 foreign nationals on the rolls, a woman arrested for allegedly voting in three elections [14]. But the claimed scale keeps outrunning the shown scale: 16,000 noncitizens alleged on Nevada's rolls against 185 confirmed internally [15][16]. And the physical take persists: 2020 presidential ballots still held from Fulton County, ballot images from Maricopa, voting machines seized from Puerto Rico [17][18]. Riverside is the set-piece. In February a sheriff seized 650,000 voted ballots — a thousand boxes — from a November 2025 special election. The state supreme court ordered them returned on September 24 [19].

Election fraud can and should be investigated. But misuse of criminal investigative tools — without any evidence that a crime was committed — needlessly undermines trust in our elections system and in law enforcement — Rob Bonta

The remedy arrived seven months after the election it concerned. A court win in every sense, and too late to touch the votes it was about. The states read the same pattern and answered in custody terms. California made seizing ballots before certification a felony, signed five days before the Riverside return order [19]. Pennsylvania put state police on election infrastructure, Missouri's attorney general threatened to arrest federal monitors, Ohio refused to hand over its data [20]. Election offices are running tabletop drills — simulated ballot seizures, simulated federal agents at the polls [21]. Both sides are now rehearsing the same scenario in empty rooms — a simulated seizure, a simulated agent at the door. That is the surest sign the fight has moved. Nobody drills for an election they think will be decided on election night.
